PART IV - PREHEARING REVIEW

SECTION A-ANALYST’S ASSESSMENT
l. Facts and Circumstances:

         a. Evidence of record shows that on 12 March 1992, the unit commander in consultation with the Clinical/Director/ADAPCP declared the applicant a rehabilitation failure. 22 April 1992, the unit commander notified the applicant of initiation of separation action under the provisions of Chapter 9, AR 635-200, by reason of alcohol abuse-rehabilitation failure, with a general, under honorable conditions discharge. He was advised of his rights. The applicant consulted with legal counsel, was advised of the impact of the discharge action, waived consideration of his case by an administrative separation board and did not submit a statement in his own behalf. The unit commander subsequently recommended separation from the service, and waiver of further rehabilitative efforts. The intermediate commander reviewed the proposed discharge action and recommended approval of the separation action with a general, under honorable conditions discharge. On 13 May 1992, the separation authority waived further rehabilitative efforts and directed that the applicant be discharged with a general discharge.

         b. On 9 June 1992, the applicant was discharged. At the time of discharge, the applicant had 3 months, and 26 days, service on his current enlistment under review and 7 years, 4 months and 2 days, total time in service.

2. Legal/Regulatory Basis for Separation Action : Army Regulation 635-200 sets forth the basic authority for the separation of enlisted personnel. Chapter 9 contains the authority and outlines the procedures for discharging individuals because of alcohol or other drug abuse. A member who has been referred to the Alcohol and Drug Abuse Prevention and Control Program (ADAPCP) for alcohol/drug abuse may be separated because of inability or refusal to participate in, cooperate in, or successfully complete such a program if there is a lack of potential for continued Army service and rehabilitation efforts are no longer practical. Army policy states that an honorable or general discharge is authorized depending on the applicant’s overall record of service. (However, an honorable discharge is required if restricted use information is used in the discharge process).

 (2) The issue is accepted. The Board carefully examined the applicant’s record of service during the period of enlistment under review. There was a full consideration of all faithful and honorable service as well as the infractions of discipline, the extent thereof, and the seriousness of the offenses. The evidence of record shows that the applicant was properly discharged under the provisions of Chapter 9, AR 635-200, by reason of alcohol abuse – rehabilitation failure. However, the Board noted that the applicant’s discharge packet for the period under review made reference to derogatory information from a prior period of honorable service. In view of the aforementioned, the Board determined the characterization of service to be inequitable. Accordingly, the Board voted to grant relief in the form of a fully honorable discharge. The Board was satisfied that the reason for discharge was proper and equitable, and voted not to change it.
